By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. 1/5

2. The relief sought in this writ petition is to direct the respondent to dispose of the petitioner's Representation dated 17.08.2024 pending on the file of respondent, in accordance with law.

The learned counsel for the petitioner submitted that the petitioner submitted an Online Application dated 22.05.2024 for surveying the property comprised in S.Nos.68/1 & 52/2A situated at Kunnankuppam Village, Kilpennathur Taluk, Tiruvannamalai District (hereinafter referred to as "subject property") and he also paid necessary fees for the same. It is further submitted by the learned counsel for the petitioner that the petitioner submitted a Representation dated 17.08.2024 before the respondent requesting to survey the portion of subject property which was sold by the petitioner vide Sale Deed dated 20.04.2017 and to measure the remaining 50 Cents of subject property based on the relevant documents. However, the respondent has not considered the petitioner's request.

4. At the outset, learned Government Advocate appearing for the respondent submitted that respondent would consider the Online 2/5

Application dated 22.05.2024 and Representation dated 17.08.2024 submitted by the petitioner, within a time frame to be fixed by this Court.

5. The above submission made by the learned Government Advocate for the respondent has been fairly conceded by the learned counsel for the petitioner.

In view of the limited relief sought by the petitioner, this Court is inclined to dispose of this Writ Petition on the following terms: (i) The respondent shall consider the petitioner's Online Application dated 22.05.2024 and Representation dated 17.08.2024, in accordance with law, after issuing notice to the petitioner, adjacent land owners and all other interested parties including rival claimants, if any. (ii) Though facts have been set out extensively in the affidavit, this Court does not propose to deal with it while leaving it open to the respondent to call for any document/conduct enquiry to satisfy itself of the petitioner's entitlement for requesting survey of subject property. (iii) The respondent shall complete the entire process within a period of twelve weeks from the date of uploading of the web copy of this order 3/5

without waiting for the receipt of a certified copy of this order. (iv) It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the respondent to consider the matter on its own merits and in accordance with law. Rights and contentions of the petitioner and all other interested parties are left open. No costs.
