The petitioner, who was arrested and remanded to judicial custody on 04.08.2022 for the offences punishable under Sections 354, 376, 406, 420 & 506(i) of IPC in Crime No.506 of 2022 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on the pretext of marriage, the petitioner had physical relationship with the de-facto complainant and thereafter, refused to marry her. Hence the complaint.

3. The learned counsel appearing for the petitioner would submit that he is an innocent person and he has been falsely implicated in this case. He would further submit that this is the second bail petition filed by the petitioner. Earlier petition filed by the petitioner was dismissed by this Court on 01.09.2022 in Crl.O.P.No.20816 of 2022. He further submitted that the petitioner is ready and willing to abide by any strigent conditions as imposed by this Court. Hence, he prays for grant of bail to the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that there are totally 4 accused persons, in which the petitioner is arrayed as A1. The de-facto complainant and the petitioner are law students. They had love affair and on false promise by the petitioner, they had sexual intercourse. Now, the petitioner is refusing to marry her and had also compelled her to abort her pregnancy. In fact, the petitioner had also taken the nude photographs of the victim girl and threatened that he will post the same in the social media. The petitioner also received a sum of Rs.3,00,000/- from the de-facto complainant. Hence, he vehemently opposed to grant bail to the petitioner.

Considering the above facts and circumstances of the case, the petitioner has committed very serious and heinous offence as against the woman and that there is no change of circumstances after the previous dismissal order passed by this Court, this Court is not inclined to grant bail to the petitioner.
