ORDER
The petitioners seek Succession Certificate in respect of the securities held by Mr.J.Krishnamurthy, who died intestate on 27.05.2023. 1/5
The 1st petitioner is the wife of the deceased and the 2nd petitioner is the daughter of the deceased. The 1TM petitioner further submits that the father and mother of the above said deceased Late.Mr.J.Krishnamurthy, had already predeceased him. Therefore the petitioners are the only legal heirs of the deceased.
2. The first petitioner has been examined as PW1. She has produced 12 documents to support her deposition which are listed as Ex.P1 to Ex.P12 at the foot of the order. The photocopies of the death certificate and the legal heirship certificate of the deceased have been marked as Ex.P1 and Ex.P2 respectively. The photocopy of the Request letter to the Bank, sent by the 1st petitioner has been marked as Ex.P3. The Reply Letter from the State Bank of India dated 28.08.2024, addressed to the 1st petitioner, has been marked as Ex.P4. The perusal of the Ex.P2, unequivocally proves that the petitioners 1 and 2 are the only legal heirs of the deceased and hence they are entitled to the securities held by the deceased which are listed under the schedule of the petition. The general paper publications has been effected which is marked as Ex.P12 and no objections have been received for the same 2/5
3. The assertions in the petition have been duly proved by adducing oral evidence supported by documents. In these circumstances, the petitioners are entitled to the relief.
4. In view of the above evidence, the Original Petition is allowed granting Succession Certificate in favour of the petitioners, with the power to collect the debts and to receive the interest and dividends on and negotiate and transfer the securities mentioned in the schedule to the petition.
