Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents, to provide employment to the petitioner wife under the 2 to 4th respondents in light of the judgement dated 08.12.2023 in W.A.No.968 of 2020 (S.Deepa Vs. Mr.K.Tippu Sultan, learned Government Advocate takes notice on behalf of the respondents. By consent, the writ petition is taken up for final disposal at the admission stage itself. 2.The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the respondents, to provide employment to the petitioner wife under the respondents 2 to 4 in light of the judgement dated 08.12.2023 in W.A.No.968 of 2020 (S.Deepa Vs. Government of Tamil Nadu and others) and by considering the petitioner's representation dated 31.05.2025. 2/6
3.The learned counsel appearing for the petitioner would submit that the petitioner's Father has donated 2.90 acres of land for the establishment of Primary Health Centre at Pavithram in the year 1989. The learned counsel would further submit that while he donated the extent of land, the Government has assured to give employment to his family members. Therefore, the petitioner sent representation to the District Collector on 02.05.2022 to give employment to his wife under the land doner category. In this connection, the learned counsel also relied upon the judgment of this Court in W.A.No.968 of 2020 (S.Deepa Vs. Government of Tamil Nadu and others) dated 08.12.2023, wherein this Court has ordered that the land doners are entitled to have employment as per the arrangement between the Government and the individual.
4.It is the further submission of the learned counsel appearing for the petitioner that the petitioner also sent representation to the first respondent on 31.05.2025 and such representation is pending with the respondents.
5.At this juncture, the learned Government Advocate would 3/6
submit that the respondents would consider the petitioner's representation upon its own merits and in accordance with law, within a reasonable time.
6.In such view of the submission, without going into the merits of the writ petition, this Court deems it appropriate to direct the respondents to consider the above representation of the petitioner upon its own merits and in accordance with law and pass orders, within a period of eight weeks from the date of receipt of a copy of this order.
