O R D E R

The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the second respondent to consider the representation dated 20.06.2023 for issuance of licence to the Shop No.H-89 situated at Periyar Vegatable Market, Koyambedu in favour of the petitioner.

2.The learned counsel appearing for the petitioner submitted that the petitioner made representation dated 20.06.2023 to the second respondent seeking issuance of licence to Shop No.H-89 situated at Periyar Vegatable Market, Koyambedu, however, there is no response. Hence, this Court may without going into the merits of the case, issue direction to the second respondent to consider the petitioner's representation dated 20.06.2023 and to pass appropriate orders, within a reasonable time frame.

3.The learned counsel appearing for the respondents 3 to 5 submitted that the petitioner filed a suit for specific performance in 2/4

O.S.No.2573 of 2008 on the file of VIII Assistant City Civil Court and the same was decreed on 27.06.2017 and challenging the same, the father of the respondents 3 to 5 filed appeal suit in A.S.No.190 of 2018 on the file of the learned II Additional Judge, Chennai and after his demise, the respondents 3 to 5 filed I.A.No.2 of 2023 to bring them on record as LRs of deceased Damodaran/ father of respondents 3 to 5 and the said appeal suit is pending.

4.Considering the limited relief now sought for by the learned counsel appearing for the petitioner, this Court, without expressing any opinion on the merits of the case, directs the official respondents to consider the petitioner's representation dated 20.06.2023, on merits and in accordance with law and to pass appropriate orders, after providing opportunity to the private respondents, within a period of six weeks from the date of receipt of a copy of this order. 5.The writ petition is disposed of.
