C.M.P.No.25458 of 2019 C.M.P.No.25458 of 2019 in C.M.P.No.12981 of 2019 in C.M.A.SR.No.29388 of 2018 R.MAHADEVAN, J.

On 27.06.2019 in CMP.No.12981 of 2019 (representation petition), this Court passed the following order:

"2. Considering the contention of the learned Counsel for the petitioner, the delay of 372 days is condoned on payment of cost of Rs.500/- (Rupees Five hundred only) to 'Kaakkum Karangal' (old age Home) at No.212/54, Amman Kovil Street (near chicken market), Parrys, Chennai 600 001, [Cell No.984006880/ 9840068889], within a period of one week from the date of receipt of a copy off this order, failing which, this petition shall stand rejected automatically, without further reference to this Court." 2.However, the petitioner has not complied with the aforesaid condition within the time stipulated by this Court. Hence, CMP.No.12981 of 2019 (representation petition) stood automatically dismissed. 3.Now, the present Miscellaneous Petition has been filed to restore the CMP.No.12981 of 2019.

4.Heard the learned counsel for the petitioner, who submitted that the conditional order has been complied with by the petitioner on 16.09.2019.

gbi 5.Considering the facts and circumstances of the case and having regard to the submissions made by the learned counsel appearing for the petitioner and being satisfied with the averments made in the petition, C.M.P.No.25458 of 2019 is ordered and C.M.P.No.12981 of 2019 is restored to file.
