This petition has been filed seeking to extend the time to pay arrears of maintenance granted in Crl.R.C.No.2170 of 2023 dated 24.06.2024 on the file of this Court.
2.The petitioner/respondent in M.C.No.29 of 2022, challenging the maintenance order dated 27.09.2023 passed by the Family Court, Krishnagiri, had filed a revision in Crl.R.C.No.2170 of 2023. This Court, by order dated 24.06.2024, finding no merits in the petitioner's contention, dismissed the revision. Further directed the petitioner to deposit the entire arrears of maintenance amount within a period of four weeks from the date of receipt of a copy of that order.
3.The contention of the learned counsel for petitioner is that the petitioner is presently posted in North-East region of Assam, a remote place and already a sum of Rs.5,970/- is being deducted from his salary. As far as 1/3
the arrears is concerned, the petitioner has to necessarily come to his native place and make arrangements. The petitioner already applied for leave and expected to come to native during the month of November, 2024. Hence, seeks extension of time.
4.Ms.R.Geethalakshmi, learned counsel appearing for the respondents strongly objected for entertaining this petition. She submitted that the petitioner has got all resources and regularly in touch with his family in his native. This petition has been filed only to further cause harassment and delay the payment of arrears of maintenance. Once the main revision itself is dismissed, the same cannot be reopened on the petitioner's contention. 5.Considering the submissions made on either side and on perusal of the order dated 24.06.2024, it is seen that this Court already passed the final order in Crl.R.C.No.2170 of 2023 dismissing the revision. In view of the same, this extension petition cannot be entertained. Hence, this Criminal Miscellaneous Petition is dismissed.
