These petitions are filed (i)under Section 5 of the Limitation Act, to condone the delay of 1649 days in filing the petition to set-aside the order of the abatement caused due to the death of the 1st respondent (ii) to set-aside the order of the abatement caused due to the death of the 1st respondent (iii) to bring on record the respondents 3 to 5 herein as the legal heirs of the deceased 1st respondent and rank them as respondents 3 to 5 in S.A. No.193 of 2007, respectively.
2.Though notice was served on the respondents 3 to 5 and their names are printed in the cause list, no one appeared on their behalf. This Court is satisfied with the reasons assigned in the affidavit filed in support of these petitions.
