Respondents Prayer : Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the 1st and 2nd respondents to dispose of the representation dated 28.09.2022 by conducting an enquiry and enabling the petitioner to carry on the fireworks and to utilize the stack yard by unveiling the seal and pass any orders or directions or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case. O R D E R

The prayer sought for herein is for a Writ of Mandamus directing the 1st and 2nd respondents to dispose of the representation dated 28.09.2022 by conducting an enquiry and enabling the petitioner to carry on the fireworks and to utilize the stack yard by unveiling the seal.

2. The petitioner claims that he is running a manufacturing unit of crackers at S.No.45/6, Premises No.437, Puliyadi Street, Kurungudi, Cuddalore District. On 26.08.2022 the police Department had an inspection and seized the raw materials, which according to the petitioner were just received by the petitioner for the purpose of manufacturing of crackers for Deepavali sales and also for regular sales. However, the raw materials were seized by the police department and had been kept in Godown, which was sealed. Therefore, in order to de-seal the premises and to permit the petitioner to involve in the manufacturing activities, the petitioner has given a representation on 28.09.2022. Since the same has not so far been considered, the petitioner has moved the present writ petition with the aforesaid prayer.

3. Having reiterated the aforesaid facts, the learned counsel for the petitioner seeks the indulgence of this Court to issue appropriate directions. 2 / 5

However, Mr.T.K.Saravanan learned Government Advocate appearing for the respondents on instructions would submit that, pursuant to the seizure of the raw materials kept for the purpose of manufacturing of crackers, the police is investigating the matter and only after completing the investigation the plea of the petitioner will be considered and decided.

In view of the aforesaid, especially in view of the stand taken by the learned Government Advocate appearing for the respondents, this Court is inclined to dispose of this writ petition with the following order. "That there shall be a direction to the respondents to consider the representation of the petitioner dated 28.09.2022 and pass orders thereon on merits and in accordance with law within a period of two weeks from the date of receipt of a copy of this order."
