Respondents Prayer : Review Application filed under Order XLVII Rule 1 read with 117 of Code of Civil Procedure to review the order passed in Tr.C.M.P.No.1075 of 2023 dated 18.06.2024 by this Court in dismissing Tr.C.M.P.
For Petitioners :
Mr.D.Ashok Kumar
O R D E R
I do not find any error apparent on the face of record. The petitioner wanted the previously instituted suit to be transferred to the City Civil Court, Chennai. All that had been done by order dated 18.06.2024 is to send the subsequent suit instituted at City Civil Court, Chennai to be tried along with the previously instituted suit at Chengalpattu. There is no dispute regarding the relationship between the parties. The suit in Chengalpattu is said to be at the stage of trial. For the mere fact that a subsequently instituted suit between the very same parties is pending at Chennai does not mean that the previously instituted suit is to be transferred and tried along with subsequent one. I do not find any reason to review my order. Accordingly, this Review Application is dismissed. No costs. Consequently, connected miscellaneous petition is closed. 25.09.2024 Index : Yes/No ms
