This application has been filed by the applicant/1st defendant to permit him to file the documents as mentioned in the Judge's summons.

2. The learned counsel for the 1st respondent/plaintiff strongly opposed to allow this application stating that the suit is pending for more than 7 years and DW1 has been fully cross examined and at this stage, this application is not maintainable and hence, he prays to dismiss the application.

3. Having satisfied with the reasons stated in the affidavit filed in support of the application, this Court is inclined to permit the applicant/1st defendant to mark the documents as listed in the Judges summons, however, subject to admissibility, relevancy and proof. Accordingly, this application is allowed.

4. Registry is directed to post the matter before the Additional Master-I, for recording evidence on 17.10.2024 and the same shall be completed within a period of two months.
