This application is filed seeking appointment of an independent commissioner to conduct a technical audit of the source code in the service 'Brandlytics' rendered by the respondent to ensure compliance of clause C of the Joint Memo dated 1.8.1018 entered between the parties. As per the Joint Memo, the restraint is only for five months from 1.8.2018.

2. Be that as it may, it is now stated that the Arbitrator dealing with the dispute was not available in the country and therefore, they have to move this court. Now it is stated that the arbitrator is back. Besides, these applications can be handled by the Arbitral Tribunal itself. Hence without prejudice to the rights and facts, it is open to them to move the Arbitral Tribunal for the reliefs sought for. It is made clear that the Arbitral Tribunal need not grant further time for the parties for filing counter. The application is disposed of and the counter filed in this regard, can be proceeded with by the Tribunal. http://www.judis.nic.in
