CMP.No.22236 of 2024 in SA.No.1255 of 2006 M. JOTHIRAMAN, J., The present petition is filed to set aside the abatement caused due to the death of the Sole respondent.

2. The learned counsel for the petitioner submits that during pendency of the second appeal the sole respondent died on 08.05.2024 leaving behind his legal heirs viz., (i)J.Rajalakshmi (ii)J.Sangeetha (iii)J.Sankari (iv)J.Saritha and (v)J.Sankar.

3. Heard the learned counsel for the petitioner and the learned counsel for the respondents. The learned counsel for the proposed respondents has stated no objection in allowing this petition and he has also made an endorsement to that effect.

4. The learned counsel Mr.P.Arumugarajan undertakes to file vakalat on behalf of the proposed respondents/legal heirs of the deceased sole respondent.

5. Being satisfied with the reasons stated in the accompanying affidavit filed in support of this petition.

6. This petition is ordered accordingly.
