This petition has been filed to enlarge the petitioner on bail pending investigation in Crime No.210 of 2023, on the file of the respondent.
2. It is the submission of the learned counsel for the petitioner that petitioner has been falsely implicated in Crime No.210 of 2023, registered for the offences under Sections 8(c), 20(b)(ii) (B), 25 & 29 (1) NDPS Act, 1985. She is in judicial custody from 04.08.2023. Thus, he seeks bail for the petitioner.
3.The learned Additional Public Prosecutor submitted that on 04.08.2023, on secret information from the defacto complainant, near Kasimedu Indira Nagar slum area, at about 10.45 a.m., they found two ladies in a red colour DIO bike with a black colour polythin bag. When enquired, they revealed their names. After following necessary procedures, a search was conducted and the accused Subha @ Vellai Subha was in possession of 1 Kg and 200 grams of Ganja in the black
colour plastic bag. Ganja and the two wheeler bearing registration No.TN 04 BB 7355 used for selling Ganja were recovered. He further submitted that the petitioner has two previous cases of similar nature pending against her. Thus, he prayed for dismissal of this petition.

Considering the nature of the offence alleged to have been committed by the petitioner and that she has two previous cases of similar nature pending against her and that investigation in this case is not completed, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. sli 19.09.2023
