ORDER
This petition has been filed to enlarge the Petitioners on bail in the event of their arrest by the Respondent Police concerned in Crime No.86 of 2025, on the file of the Respondent Police pending investigation.
2. The case of the prosecution is that the petitioners along with other accused persons entered into the house of the defacto complainant and abused him and his wife in filthy language and also assaulted them with hands, due to which the defacto complainant's wife was depressed and committed suicide by writing suicide note through Whatsapp and voice message. Based on the complaint of the defacto complainant, the respondent p olice registered FIR
under Sections 115(2), 296(b), 108 of BNS and Section 4 of TNPWH Act.
3. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and in fact they are neighbours. Further, the petitioners are female members of the family. Hence, he prays to grant bail to the petitioner.
4. The learned Government advocate submits that co-accused was already arrested and released on bail. However, he raised objection to grant bail. 5.
Considering the facts and circumstances of the case and also the fact that co-accused was arrested and released on bail and the petitioners are female family members of first accused. Hence, this Court is inclined to grant bail to the petitioner with conditions.
6.Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen days from the date of receipt of a copy of this order, before the Judicial Magistrate No.II, Ponneri, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties each for a like sum to the satisfaction of the respondent police or the police officer who intends
to arrest or to the satisfaction of the learned Magistrate concerned and on further condition that:
[a] the petitioners and the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity. [b] the petitioners are directed to report before the respondent police on every Saturday at 10.00 a.m for a period of 8 weeks.
[c] the petitioners shall not tamper with evidence or witness either during investigation or trial. [d] the petitioners shall not abscond either during investigation or trial.
[e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].
