Aggrieved by the award passed by the 1st respondent fixing quantum of compensation for the lands acquired for industrial purpose, the petitioner has came by way of this writ petition.

The property comprised in Survey No.249/6G measuring an extent of 2400 sq.ft., situated in Vaipur Village, Sriperumbudur Taluk, Kancheepuram District, was purchased by the petitioner from one M.Ganesan on 17.03.2008. Thus, the petitioner claims ownership over the above said property. The said property was acquired by the respondents for expansion of SIPCOT, Oragadam Industrial Growth Centre Expansion-II, Sriperumbudur. The 1st respondent passed an award on 31.10.2020 fixing quantum of compensation. Not satisfied with the quantum of compensation fixed by the 1st respondent, the petitioner has come before this Court. 2/5

If the petitioner is not satisfied by the quantum of compensation fixed by the 1st respondent, it is for him to seek reference under Section 8 of the Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997. Therefore, the prayer sought for by the petitioner in this writ petition cannot be entertained. However, it is also seen from the typed-set of papers that the petitioner also filed an application dated 10.01.2022 before the 2nd respondent seeking reference before the Civil Court for enhancement of compensation.

Therefore, without going into the merits of the claim made by the petitioner, this Court is inclined to direct the 2nd respondent to forward the application dated 10.01.2022 submitted by the petitioner to 1st respondent within a period of two weeks from the date of receipt of copy of this order. The 1st respondent shall consider the application of the petitioner and pass final orders on its own merits and in accordance with law, within a period of six weeks from the date of receipt of application from the 2nd respondent.
5. With the above directions, the Writ Petition stands disposed of. No 3/5
costs.
