Crl.O.P.No.21308 of 2023 G.CHANDRASEKHARAN.J., The petitioner namely Yuvaraj, who was arrested and remanded to judicial custody on 05.07.2023 for the offences under Sections 341, 294(b), 336, 427, 397, 506(ii) of IPC in Crime No.275 of 2023 on the file of the respondent police, seeks bail.
2. The learned counsel for the petitioner submitted that, petitioner is an innocent person and he is falsely implicated in a case registered in Crime No. 275 of 2023 for the offences under Sections 341, 294(b), 336, 427, 397, 506(ii) of IPC in Crime No.275 of 2023. Petitioner is in Judicial Custody from 05.07.2023. Thus, he seeks bail to the petitioner.
3. In response, learned Additional Public Prosecutor submitted that, on 05.07.2023 at about 08.30.p.m., defacto complainant after completing his work, was returning home via Mylapore. At that time, accused waylaid the defacto complainant and threatened him by demanding money. When defacto complainant told him that, he had 1/4
no money, accused had abused him in filthy language and forcibly took a sum of Rs. 500 and a cell phone from his shirt pocket. He further submitted that, petitioner has following previous cases pending against him:
1. E-1 P.S Crime No.286 of 2019 under Section 380 of IPC
2. E-1 P.S Crime No.287 of 2019 under Section 380 of IPC
3. E-1 P.S Crime No.510 of 2019 under Section 380 of IPC
4. E-1 P.S Crime No.997 of 2020 under Section 394 of IPC
5. E-1 P.S Crime No.86 of 2021 under Section 399 of IPC
6. E-1 P.S Crime No.1033 of 2021 under Sections 25(1-A) ARMS Act, 147, 148, 294(b), 307, 323, 341, 448, 506(2) of IPC
7. E-1 P.S Crime No.323 of 2022 under Sections 20(b)(ii)(B), 8(c) of NDPS Act
4. Considering the nature of the allegations made against the petitioner and the petitioner has multiple previous cases pending against him and that investigation in this case is not completed, this Court is not inclined to grant bail to the petitioner.
5. Accordingly, this Criminal Original Petition is dismissed. 2/4
