Crl.O.P.No.21332 of 2023 G.CHANDRASEKHARAN.J., The petitioner namely Manikandan, who was arrested and remanded to judicial custody on 30.06.2023 for the offence under Sections 302 of IPC in Crime No.1088 of 2023 on the file of the respondent police, seeks bail.

The learned counsel for the petitioner submitted that, petitioner is an innocent person and he has been falsely implicated in a case registered in Crime No. 1088 of 2023 for the offence under Section 302 of IPC. Petitioner is in Judicial Custody from 30.06.2023. Thus, he seeks bail to the petitioner.
3.In response, the learned Additional Public Prosecutor submitted that, deceased is the second wife of the petitioner. Petitioner used to suspect the deceased and he prevented the deceased from speaking to her parents. He used to harass her. At one stage, deceased consumed poison. However, she was saved by neighbors. On 30.06.2023, defacto complainant was informed that deceased was murdered by the petitioner, herein. Defacto complainant, on visiting the house of the petitioner, found that, her daughter's head was severed and kept in a 1/3
plastic container. Investigation in this case is completed and final report is filed. However, he strongly, opposed this petitioner.
4. Considered the rival submissions and perused the records. It is seen from the postmortem report of the deceased that, deceased suffered several cut injuries, as many as 67 injuries. Though investigation in this case is completed and final report is filed, considering the nature of extensive cut injuries suffered by the deceased because of the gruesome attack by the petitioner, and that if the petitioner is released on bail, he will threaten the witnesses and tamper the evidence and that would obstruct the fair trial, this Court is not inclined to grant bail to the petitioner.
5. Accordingly, this Criminal Original Petition is dismissed. However, the learned trial Judge is directed to dispose the case as expeditiously as possible.
