PRAYER : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the 2nd respondent Police to trace the missing original document or to issue Non Traceable Certificate with regard to the Original Sale Deed viz Document No.537 of 1991 dated 05.03.1991 registered in the Office of the Sub Registrar, Dharapuram, Tirupur District in pursuant to the complaint given to the 2nd respondent on 08.03.2023 and reminder letter to the 1st respondent dated 07.05.2023 and paper publication dated 14.03.2023 in the Dhinathanthi newspaper, Tirupur Edition. 1/4

This Criminal Original Petition has been filed for a direction to the 2nd respondent to issue Non-Traceable Certificate to the petitioner regarding the Original Sale Deed bearing Document No.537 of 1991 on the file of the Sub Registrar, Dharapuram,

2. Learned counsel for the petitioner would submit that the petitioner had lost his original sale deed bearing Document No.537 of 1991 on the file of the Sub Registrar, Dharapuram, Tirupur District. Hence, he preferred a complaint on 08.03.2023 before the 2nd respondent.

3. Learned Additional Public Prosecutor, on instructions, submitted that the complaint given by the petitioner will be considered in line with the circular issued by the Director General of Police. Learned Additional Public Prosecutor submitted that the petitioner may be directed to produce the necessary documents before the respondent police in order to complete the enquiry and to give the Non-traceable certificate. 2/4

4. Under such circumstances, there shall be a direction to the petitioner to attend the enquiry before the 2nd respondent along with all the necessary documents. The 2nd respondent shall conduct the enquiry in line with the circular Memorandum dated 01.04.2022 issued by the Director General of Police. Ultimately, if the respondent is satisfied after the enquiry, Non-traceable Certificate shall be issued to the petitioner. This process shall be completed by the first respondent within a period of six (6) weeks from the date of receipt of a copy of this order.
