Respondent(s) PRAYER directing the respondents to consider the Representations dated 07.03.2025 and 12.03.2025 consequently direct the Respondents for construction of bridge for access as promised and allowing the petitioner to resume farming operations and transport the Petitioner agricultural products without further hindrances to the petitioner land.

ORDER

This writ petition has been filed for the issue of a writ of mandamus directing the respondents to deal with the representations made by the petitioner on 07.03.2025 and 12.03.2025, wherein the petitioner is seeking for construction of a bridge for access to the agricultural land as was promised when the scheme was made.

When the matter is taken up for hearing today, the learned Additional Government Pleader appearing on behalf of the respondents produced the written instructions received from the Assistant Engineer, Water Resources Department, Palacode and the relevant portions are extracted hereunder: "The work involves construction of a new canal to diver the surplus water of Chinnar River by excavation of new supply canal from L.S.5.00 Km of Page No.3 of 7

the existing Jerthalav Canal to feed Erranahalli Tank, Pulikarai Tank and 12 other Tanks in Palacode Tanks of Dharmapuri District. This canal is having length of 14.385 Km covering 8 Villages and to benefit an ayacut of 432.80 acres.

In this scheme in Karagathahalli Village in Survey Nos.7, 8, 356, the canal excavation work is in progress only. The work was not yet completed. In the petitioner's land the canal excavation work is in progress. During the excavation of the petitioner's land the bridge will be constructed before completion of the canal work. The construction of new canal work was still in progress only. Before completion of the work the bridge will be constructed in the petitioner's land. Now the approach will be provided to cross the canal in the above said survey numbers of petitioner land. The petitioner's request will be considered and the bridge will be constructed in the Survey No.8 for their approach."

3. In view of the above, it is seen that already temporary arrangements are Page No.4 of 7

made for the construction of the bridge for access to the agricultural lands. The temporary arrangements in this process shall be completed within a period of 4 weeks from the date of receipt of a copy of this order. Thereafter, the permanent arrangements shall be made upon the completion of the entire construction.
