Prayer: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorari to call for the records of the impugned order Na.Ka./230/2013 dated 25.05.2016 passed by the 2nd respondent herein, and quash the same.

ORDER

Aggrieved by the impugned award of the 2nd respondent/Authorised Officer, the petitioner has filed this Writ Petition.

It is the case of the petitioner that the 1st respondent filed a petition under Tamil Nadu Industrial Establishments (Conferment of Permanent Status to Workmen) Act before the 2nd respondent/Authorised Officer seeking permanent status for 204 labours/workmen who are alleged to be working as casuals in the petitioner management, wherein, the impugned award has been passed by the Authorised Officer granting permanent status in respect of 15 workmen as per the annexure appended to the impugned order. Challenging the same, the petitioner is before this Court.

When the matter is taken up, learned counsel for the petitioner submits that pursuant to the award passed by the Authorised Officer granting permanent status in respect of the 15 workmen, 9 of them failed to report to duty and the services of the remaining 5 of the workmen were regularised on the basis of NTC Regularize Casual Scheme.

4. Since the order passed by the Authority under Tamil Nadu Industrial Establishments (Conferment of Permanent Status to Workmen) Act has already been implemented, nothing survives for further adjudication in this Writ Petition.
