JUDGMENT

(Delivered by the Hon'ble Chief Justice) We have heard Mr.AL.Somayaji, learned Senior Counsel appearing on behalf of M/s.Gupta and Ravi, for the appellant; and Mr.S.Kumarasamy, learned counsel for the first respondent.

2. Mr.AL.Somayaji, learned Senior Counsel for the appellant, submits that the order passed by the learned Single Judge is not clear. The appellant had already granted increase of Rs.3,800/- with effect from 1.10.2018; Rs.2,250/- with effect from 1.10.2019; and Rs.1,750/- with effect from 1.10.2020. However, the learned Single Judge had ordered increase to the tune of Rs.5,000/-; Rs.3,200/- and Rs.2000/- for the aforesaid periods, respectively. It is not clear whether Rs.5,000/- ordered to be paid is over and

above Rs.3,800/- granted by the appellant or the appellant has to pay Rs.1,200/- more. Learned Senior Counsel submits that he would withdraw the present appeal and file an application before the learned Single Judge.

3. In the light of the request made, the appeal is disposed of. The appellant may file an application before the learned Single Judge, as may be permissible, and depending upon the order to be passed in the application, the appellant may take further steps. There will be no order as to costs. Consequently, C.M.P.No.21290 of 2023 is closed.
