O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offence under Section 309(4) of BNS Act, 2023 in Crime No.173 of 2025, on the file of the respondent police, seeks anticipatory bail. 1/4

2. The allegation against the petitioner is that the petitioner joined hands with other accused waylaid the defacto complainant while parked his vehicle for natural call, attacked him and taken away his i-phone, laptop and gold chain worth about Rs.60,000/-. Hence, the case has been registered.

3. The learned counsel for the petitioner submitted that he is innocent and he has been falsely implicated in this case based on the confession given by other accused. He further submitted that the property was also recovered. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent reported that the petitioner joined hands with other accused waylaid and taken away the valuables from the defacto complainant and the petitioner herein is concerned, he taken away i-phone from him and subsequently the property was recovered. He further submitted that four previous cases of similar in nature has been registered against him. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case, taking note of the submission made by the learned Government Advocate (Crl.Side), and 2/4

also the fact that his previous bad antecedents having four previous cases of similar in nature, this Court is not inclined to grant anticipatory bail to the petitioner.
