ORDER
(Order of the Court was made by J.Nisha Banu, J.) The present Habeas Corpus Petition is filed by the father of the detenue, seeking direction to the respondents to produce his daughter namely, Santhiya, aged about 19 years before this Court from the custody of the third respondent and set her at liberty.
2. It is the case of the petitioner that his daughter Santhiya was continuously disturbed by the third respondent, who is residing next to the petitioner's house, insisting that she should talk with him. In view of the act of the third respondent, the petitioner left his daughter at his brother's house at Virudhachalam, Cuddalore. On 10.07.2025, at about 8.00 p.m., when the petitioner's daughter came out to the road, the third respondent, along with his friends, came on a two wheeler and took her away. According to the petitioner, the third respondent is an accused person having bad antecedents and though a complaint was registered in Crime No.181/2025 as " woman missing", no effective steps have been taken by the respondents to trace the detenue. Hence this petition.
3. When the case was listed on 11.09.2025, the detenue was produced before this Court from Annai Alamelu Old age Home, Cuddalore, and she expressed that she was not willing to go either with the parents or with the third respondent. Hence the detenue was directed to stay at Home till 25.09.2025.
4. Today, when the matter is taken up for hearing, the detenue is produced before this Court from the Home. Upon interaction, she expressed her willingness to go with her father/ petitioner.
5. The detenue is aged about 19 years and she is willing to go with her father/petitioner. Recording the same, and finding that there is no illegal detention, this Habeas Corpus Petition is closed.
