The petitioner, who was arrested and remanded to judicial custody on 19.05.2024, for the alleged offence punishable under Sections 8(c) r/w 20(b)ii(C),25 and 29(1) of NDPS Act in Crime No.23 of 2024, on the file of the respondent police, seek bail.

2.The case of the prosecution is that the petitioner along with other accused were in possession of 106.400 kgs of dry ganja. Hence the complaint.

3. The learned counsel for the petitioner would contend that the petitioner is an innocent and a false case has been foisted against him. He would further submit that the petitioner is no way connected with the said occurrence.

4.The learned Government Advocate (Crl.Side) appearing for the respondent police would contend thatthe petitioner along with other accused were in possession of 106.400 kgs of dry ganja. He also submitted that this Court has already dismissed the bail application of the petitioner vide order dated 13.08.2024 in Crl.O.P.No.19457 of 2024 1/3

5.Heard both side and perused the materials available on record. 6.Considering the fact that the quantity involved in this case is commercial in nature and taking note of the fact that this Court dismissed the earlier bail application filed by the petitioner in Crl.O.P.No. 19457 of 2024 dated 13.08.2024 and now there are no change in circumstances, this Court is not inclined to grant bail to the petitioner at this stage. Accordingly, this Criminal Original Petition stands dismissed. 18.10.2024 smn 2/3
