PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus or any other appropriate Writ, Order or Direction in the nature of Writ, directing the Respondents to take appropriate action on petitioners representation dated 30.05.2025 and to issue corrected computerized patta by removing the word Temple under the usage column and incorporate the correct usage of land for the land admeasuring 3308 sq.ft situated in Door No 1101A, Town survey no 2 village Natham Survey no 1471/ 1F, Ward D, Block 27 in Madhavaram Village, madhavaram Taluk, Chennai District bearing the patta duly assigned and issued in petitioners name by the Revenue Department in the year of 2015 bearing patta. ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

The present Writ Petition is filed praying for a Writ of Mandamus to direct respondents to take action on petitioner's representation dated 30.05.2025 for issuance of corrected computerized patta in respect of subject property comprised in Door No.1101A, Town Survey No.2, village Natham Survey 2/8

No.1471/1F, Ward-D, Block-27 measuring an extent of 3308 Sq.ft situated at Madhavaram Village and Taluk, Chennai District by removing the word "Temple" under the usage column.

It is submitted by the learned counsel for the petitioner that petitioner submitted a representation dated 30.05.2025 to the respondents for issuance of the corrected computerized patta in respect of the subject property. However, petitioner's representation was not considered. Aggrieved by the same, petitioner has come before this Court.

At the outset, the learned Special Government Pleader appearing for the respondents would submit that Survey number in respect of which patta has been issued in the name of the petitioner is shown as 1471/1FUA while the prayer has been made in respect of Survey No.1471/1F which is classified as Government Poromboke. He would further submit that if the subject land is a Government poromboke land, then petitioner may not be entitled for issuance of patta. In any view, petitioner's representation dated 30.05.2025 would be 3/8

considered and appropriate orders would be passed in accordance with law, after issuing notice to the petitioner as well as the temple authorities and any other interested parties including the rival claimants, if any, within a time frame to be fixed by this Court, which was agreed to by the learned counsel for petitioner.

In view of the limited relief that is prayed, this court is inclined to dispose of the writ petition with following directions; i) The concerned respondent shall consider the representation dated 30.05.2025, after issuing notice and affording a reasonable opportunity of hearing to the petitioner as well as the concerned Assistant Commissioner, Hindu Religious and Charitable Endowments Department and any other interested parties including rival claimants, if any. ii) Though facts have been set out in affidavit, in view of the limited relief that is sought to be granted, I do not propose to examine the same, lest it may influence the authority. The authority shall independently consider the facts and 4/8

law set out in the representation and pass appropriate order in accordance with law including but not limited to the provisions of the Tamil Nadu Patta Pass Book Act and Rules.

iii) The petitioner's representation dated 30.05.2025 shall be disposed of within a period of 12 weeks from the date of uploading of web copy without waiting for the receipt of certified copy.

iv) It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law. Rights and contentions of the petitioner and all other interested parties are left open.

6. There will be no order as to cost.
