Respondents/Defendants Prayer: Appeal against the judgment and decree of the Court of the Principal Sub Court, Thiruvannamalai, Thiruvannamalai, dated 10.04.2014 in A.S.No.56 of 2013 preferred against the judgment and decree of the Court of the Additional District Munsif, Thiruvannamalai, dated 28.02.2012 in O.S.No.16 of 2005. Decree : This Second Appeal coming on for hearing on this day upon perusing the grounds of Appeal, the judgment and decees of the Lower Appellate Court and the Court of First instance and the material papers in the suit and upon hearing the arguments of Mr.R.Rajarajan, Advocate for the Appellant and of Mr.K.Venkatasubban for M/s.Sarvabhauman Associates, for the Respondents 3 and 4 and though notice was served to the 1st and 2nd respondents and not appearing in person or by an Advocate, this Court doth order and decree as follows:

1) that the judgment and decree passed by the Principal Sub Court, Thiruvannamalai, dated 10.04.2014 made in A.S.No.56 of 2013 against the judgment and decree passed by the Additional District Munsif, Thiruvannamalai, dated 28.02.2012 made in O.S.No.16 of 2005 be and hereby are confirmed, Second Appeal is dismissed;

2) that there be no order as to costs;
