Respondents Prayer:- Criminal Original Petition is filed under Section 482 Cr.P.C., to direct the 2nd respondent to re-investigate and file final report in Crime No.470 of 2015 dated 31.12.2015 offence under Sections 147, 148, 294(b), 323 and 506(ii) of IPC pending before the Hon'ble Judicial Magistrate, Sankarapuram, Villupuram District.

ORDER

The petitioner has come forward with this petition under Section 482 of Code of Criminal Procedure, seeking a direction to the 2nd respondent police to file a final report in Crime No.470 of 2015.

2. The learned counsel for the petitioner would submit that on the basis of the complaint given by the petitioner, a case has been registered in Crime No.470 of 2015 for the offences punishable under Sections 147, 148, 294(b), 323 and 506(ii) of IPC. However, the second respondent has not shown any interest to investigate the matter and lay a final report. Hence, the petitioner has come up with the present petition for the relief as stated above.

3. At this juncture, the learned Additional Public Prosecutor appearing for the respondents would submit that already investigation has been conducted and it was closed as mistake of fact. He would further submit that referred charge sheet has been filed in R.C.S.No.1 of 2016 before the learned Judicial Magistrate, Sankarapuram on 15.02.2016.

4. Recording the submission made by the learned Additional Public Prosecutor, this Criminal Original Petition is closed. However, it is left open to the petitioner to file a petition for protest on receipt of the summons in R.C.S.No.1 of 2016.
