PRAYER: The writ petition filed under Article 226 of the Constitution of India, for issuance of a writ of Mandamus, directing the first respondent to consider and conduct enquiry over the appeal filed by the petitioner dated 03.07.2023 under Section 18 of the Right to Information Act, 2005 and to direct the third respondent to furnish the information and copies of the documents claimed by the petitioner in his application submitted under Section 6(1) of the Right to Information Act, 2005 dated 17.04.2023. ORDER

By consent, this writ petition is taken up for final disposal at the admission stage itself.

2.The petitioner has preferred a second appeal before the first respondent under the provision of Right to Information Act, 2005. 3.Mr.C.Vigneswaran, the learned counsel takes notice for the first respondent, and Mr.M.Fakkir Mohideen, the learned Standing Counsel takes 2/4

notice for the respondents 2 and 3.

4.The learned counsel for the first respondent submitted that he has filed the appeal only in the month of July and due to a sheer paucity of staff vis-a-vis the inflow of appeals, it is yet to be taken on file. 5.Heard the learned counsel for the petitioner as well as the learned counsel for the respondents.

6.The first respondent is now required to take the matter onto the record, if the papers are otherwise in order within a period of three (3) weeks from the date of receipt of the order copy or the date on which the order is hosted in the official website, whichever is earlier, and to dispose of the appeal after complying all procedures contemplated within a period of twelve (12) weeks thereafter.
