Respondents PRAYER: Petition under Article 226 of the Constitution of India for issuance of a writ of Certiorarified Mandamus to call for the records relating to the order of the 2nd respondent in Na.Ka. No.4178/ 2016/A2, dated 10.6.2016 and quash the same and consequently direct the 2nd respondent to remove the encroachment by respondents 5 & 6 in S.F.No.569/1 which is a public road by width of 15 Feet within a stipulated time.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) The revenue authorities have not found any cart track encroachment, as alleged by the petitioner. If it is an issue of demarcation, etc., the petitioner is free to file a civil suit in accordance with law.

The petition is dismissed with the aforesaid liberty. No costs.
