The petitioners who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 4(1)(aa), 4(1-A) of TNP Act in Crime No.265 of 2022, seek anticipatory bail. 2.The case of the prosecution is that the petitioners were found in illegal possession of 55 litres of ID arrack. Hence, the complaint. 3.The learned counsel for the petitioners would submit that the petitioners are innocent persons and they have been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioners. 4.Per contra, the learned Government Advocate (Crl. Side) would submit that the petitioners are habitual offenders against whom there are three previous cases similar in nature pending against them. Hence, he vehemently opposed for the grant of anticipatory bail to the petitioners.

vkr 5.Taking into account the nature of offence and the previous antecedents of the petitioners, this Court is not inclined to grant anticipatory bail to the petitioners. Accordingly, this Criminal Original Petition is dismissed.
