Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus, directing the fourth respondent to cancel the assignment patta in survey numbers 45/2, 46/1, 46/5 for lying Thar road with an extent of 100 meters situated at 74 Krishnapuram Panchayat, Gangavalli Taluk, Salem District made by the fifth respondent based on the petitioner's representation dated 21.07.2023.

ORDER

(Made by the Hon'ble Chief Justice) Heard Mr.L.Rajendran, learned counsel for the petitioner and Mr.P.Muthukumar, learned State Government Pleader assisted by Mr.K.M.D.Muhilan, learned Additional Government Pleader for respondents 1 to 4.

2. The petitioner is assailing the pattas granted in favour of respondents 5 and 6.

3. Learned State Government Pleader submits that if a person is aggrieved against grant of patta, an alternate remedy is provided under Section 12 of the Tamil Nadu Patta Passbook Act, 1983.

4. In the light of that, if the petitioner is aggrieved, then the petitioner can avail the alternate remedy available under Section 12 of the Tamil Nadu Patta Passbook Act, 1983, as may be permissible under law.

5. With these observations, the writ petition stands disposed of. There will be no order as to costs.
