Naveen COMMON ORDER These three applications have been filed owing to the death of the sole appellant to condone the delay of 1630 days in filing the application to set aside the abatement and to set aside abatement and to bring on record the legal representatives of the deceased sole appellant.
2. In the common affidavit filed in support of the applications, it had been contended that the petitioners were not aware of the legal requirements to implead the legal representatives and after coming to 1/2 https://www.mhc.tn.gov.in/judis
CMP Nos.18377 , 18378 & 18380 of 2025 C.V. KARTHIKEYAN,J., vum know the same, they immediately made necessary instructions to their counsel.
3. It is to be noted that this appeal apart, there are three connected Second Appeals in S.A.Nos.724, 763 and 765 of 2009 to be heard jointly. All the three appeals relates to the same subject matter and have to be listed together.
4. In view of the particular fact that the appellants are ready to prosecute the appeal, the delay is condoned. All the three applications are allowed.
5. Registry to note the death of the appellant and bring on record the petitoners herein as further appellants in the present Second Appeal and list the same along with S.A.Nos.724, 763 and 765 of 2009 on 03.09.2025. 31-07-2025 vum To
