[Order of the court was made by M.M.SUNDRESH,J.] This Miscellaneous Petition is filed seeking extension of time granted to rectify the defects in the Petitioner Unit, by an order dated 03.07.2019 passed in W.M.P.No.16889 of 2019 in W.P.No.1505 of 2019, for a further period of three months.

Learned counsel for the Petitioner submitted that rectification process is on, and that, it could not be completed, as there is a dispute between the partners and that, electricity supply was restored to the premises only after 1 1⁄2 months from the date of the order of this Court, ordering rectification of defects.

Learned counsel appearing for the Respondent/Pollution Control Board, submitted that, time sought by the Petitioner for rectifying the defects had already expired, and this Court had already granted extension of time, by an order dated 03.07.2019, and that internal dispute, cannot be a ground for Page No.1 / 3
seeking extension of time. He further submitted that, if this Court is inclined to consider extension of time to the Petitioner, the same shall be granted on the very same conditions, which is inclusive of the Petitioner not doing Dyeing operation.

Considering the submissions made, we are of the view that the Petitioner can be given one more extension, as a final chance and accordingly, the Petitioner is granted further extension of time for a period of two months from the date of receipt of a copy of this order, to rectify the defects. This is subject to the condition that the Petitioner shall not involve in any dyeing operation, till rectification is completed to the satisfaction of the Respondent/Pollution Control Board.
