ORDER

This Criminal Revision case has been filed to Set aside the Judgement passed by the Court below in S.T.C.No.6 of 2023 dated 09.12.2024, on the file of the Judicial Magistrate No.II, Pollachi.

2. On 09.12.2024, none represented for the petitioner. Hence, the Trial Court has dismissed STC No. 6 of 2023 for default. Aggrieved over the same, the petitioner filed this revision.

3. The learned counsel for the petitioner submits that on that date of passing order the petitioner was unwell so he was not able to appear before the Trial Court, his absence is neither wilful not wanton and near about Rs.10 lakhs cheque amount is under dispute. Hence, he seeks one more opportunity to prove the claim.

4. Considering the facts of the case, this Court is inclined to give one more opportunity to the petitioner to prove his claim. Therefore, the order passed by the Judicial Magistrate No.II, Pollachi, in STC No. 6 of 2023, dated 09.12.2024 is hereby set aside.
