ORDER
This Criminal Revision has been filed to set aside the condition imposed on the petitioner in Para No.5(i) in Crl.M.P.No.1498 of 2025 dated 09.06.2025 on the file of the learned Judicial Magistrate-II, Chengalpet.
2. Heard the learned counsel appearing on either side and perused the materials available on record.
3. On perusal of the records, it is seen that petitioner is the complainant and he has been defrauded by the accused persons. Hence, he lodged a complaint before the respondent police and a case has been registered in Crime No.110 of 2024. Thereafter, the petitioner had filed a petition seeking return of his cash before the Trial Court. The Trial Court allowed the petition and ordered to transfer the amount of Rs.1,81,36,271.19/- to the petitioner's bank account with one of the condition that the petitioner should execute a bond for Rs.1,80,00,000/-(Rupees One Crore Eighty Lakhs only) along with two sureties each for a likesum to the satisfaction of the Judicial Magistrate No.II, Chengalpattu.
4. In view of the above, this Court is inclined to delete the condition imposed on the petitioner in Para No.5(i) in Crl.M.P.No.1498 of 2025 dated 09.06.2025 on the file of the learned Judicial Magistrate-II, Chengalpet.
Accordingly, the condition imposed on the petitioner in Para No.5(i) in Crl.M.P.No.1498 of 2025 dated 09.06.2025 on the file of the learned Judicial Magistrate-II, Chengalpet is set aside. The Criminal Revision Case stands allowed.
