The petitioner, who was arrested and remanded to judicial custody on 26.06.2025, for the offence punishable under Section 7 read with 8 of POCSO Act, 2012, in Crime No.28 of 2025, registered on the file of the respondent, seeks bail.

2.The case of the prosecution is that the petitioner is the step father of the victim girl. The complainant is the mother of the victim girl. On 03.12.2024, when the victim girl went to her house to collect her dress, at that time the petitioner kiss the victim girl and committed penetrative sexual assault. Hence, the complainant lodged the complaint against the petitioner.. 3.The learned counsel for the petitioner submitted that the petitioner has been falsely implicated by the complainant. He further submitted that the petitioner has been in judicial custody from 26.06.2025. Hence, prayed for grant of bail to the petitioner.

4.The learned Government Advocate (Criminal side) submitted that the investigation is almost completed and the final report is likely to be filed soon. Further, the learned Government Advocate submitted that the petitioner is the step father of the victim girl and, if the petitioner is released on bail, the victim girl may be subjected to further sexual harassment. Hence, strongly opposed for grant of bail to the petitioner.

5.Heard the learned counsel on either side and perused the records. 2/4

6.Considering the fact that the petitioner misbehaved with the minor girl and due to the fact that the investigation is crucial of stage and release of this petitioner will hamper the investigation, this Court is not inclined to grant bail to the petitioner. Accordingly, the Criminal Original Petition stands dismissed. 18.08.2025 mp Note :
