PRAYER: Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure, to direct the second respondent to provide the police protection to survey the petitioner's brother land in survey No.242 of 2 situated at Edayalam Village, Madurantakam Taluk, Kancheepuram District. O R D E R

This petition has been filed for a direction to direct the second respondent to provide the police protection to survey the petitioner's brother's land in survey No.242 of 2 situated at Edayalam Village, Madurantakam Taluk, Kancheepuram District.

2. Heard Mr.P.Anbazhagan, learned counsel for the petitioner and Mr.M.Mohammed Riyaz, learned Additional Public Prosecutor for the first and second respondents.

3. It is evident that earlier the petitioner has submitted representation to the Tahsildar and the Tahsildar has allotted the surveyor to survey the land in question. The same stated to be prevented by one Murugesan and his wife.

4. In the said circumstance, the Tahsildar is hereby directed to allot the surveyor to survey the land in question once again. If the surveyor finds any difficulties, he can seek for police protection. On the request of the surveyor, the second respondent is directed to conduct an enquiry and after issuing notice to the counter party, pass reasoned orders on merits in accordance with law.

5. With the above direction, this Criminal Original petition is disposed of.
