mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows: TERMS OF SETTLEMENT Both the parties and their respective counsel are present. 2.This appeal has been filed by the Claimant as against the award passed by the Tribunal dated 02.04.2024 passed in M.C.O.P.No.3441 of 2017.
3.Ms.Nazira Banu, learned counsel had entered appearance in the C.M.A.No.3441 of 2017. The parties have now agreed for the full quit for a sum of Rs.3,50,000/- (Rupees Three Lakhs Fifty Thousand only) for the award amount of Rs.2,42,000/-, excluding the amount already deposited. 4.It is represented by the second respondent/Shriram General Insurance Co. Ltd., that they are ready to deposit a sum of Rs.3,50,000/- as full quit to the credit of the M.C.O.P.No.3441 of 2017. The second respondent/ Shriram General Insurance Co. Ltd shall deposit a sum of Rs.3,50,000/-(Rupees Three Lakhs Fifty Thousand only) excluding the amount already deposited before the Tribunal, if any, within a period of six (6) weeks from the date of receipt of a copy of this order.
5. The Tribunal is directed to transfer the above said award amount to the Bank account of the appellant / claimant by way of NEFT / RTGS,
on proper identification, in accordance with the terms of the award, without insisting on any formal permission petition. 6.The Civil Miscellaneous Appeal is disposed of accordingly. No costs.
