This petition is filed to condone the delay of 17 days in filing the appeal.

2. The notice sent to the respondent was returned with an endorsement "refused". Since it was a case of deemed service, we directed the Registry to print the name of the respondent. Accordingly, the name of the respondent is printed in the cause list. Despite the same, none appears.

3. In view of the reasons found mentioned in the affidavit filed in support of the Miscellaneous Petition, the delay is condoned.

The Miscellaneous Petition is allowed.
