ORDER

On the complaint given by one Iyappan on 17.05.2025 in Crime No.156 of 2025, a case has been registered against the petitioner herein for the Page No.1/4

offences under Sections 126 (1), 296(b), 115(2), 324 (4), 125(a), 311 and 351

(3) of BNS Act, 2023.

2. As per the prosecution, the petitioner had threatened the defacto complainant, who is an auto driver and robbed a sum of Rs.350/- from his pocket at knife point. Earlier bail petition was dismissed by the Court taking into consideration the petitioner been detained under Act 14 of 1982.

3. Today, it is reported that the detention order has been revoked and so far final report not yet filed.

4. In view of the above fact that though the petitioner is an history sheeter and ten previous case is pending against him, since the final report not filed within a statutory period, this Court is inclined to grant bail to the petitioner with certain conditions.

5. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, each for a like sum to the satisfaction of the learned 23rd Metropolitan Magistrate, Saidapet, and on further conditions that : [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy Page No.2/4

of any one of the identity proofs to ensure their identity; [b] the petitioner shall report before the concerned Magistrate daily at 10.00a.m until further orders.

[c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];

[d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 11.08.2025 nr Note :
