The petitioner herein is the second accused in Cr.No.2 of 2022 for the alleged offences under sections 120B, 467, 468, 471, 420, 511 of I.P.C and 66 D of IT Act 2000.

2. The course of investigation, the petitioner's bank account maintained at Kotak Mahindra Bank, Salt Lake, Sector III Branch, Kolkatta, West Bengal been freezed on the instructions of the Investigating Officer.

3. The present petition is filed seeking direction to defreeze the account.

4. The learned Government Advocate (Crl.Side) submits that on completion of investigation, final report filed on 28.06.2023 and the same has been taken on file in C.C.No.722 of 2023 by the learned Judicial Magistrate-III, Tirupur.

5. In the light of the above fact, it is suffice to permit the petitioner to approach the trial court and seek for necessary remedy as contemplated under the code of Criminal Procedure (Chapter 34).

6. The learned Magistrate, if any such application is filed, shall consider the same and pass appropriate orders passed on the records and merits within a period of two months from the filing of the petition.

7. With the above directions, this Criminal Original Petition is disposed of.
