ORDER
This petition has been filed, praying to modify the condition in para No.7(b) imposed on the petitioner in Crl.O.P.No.15253 of 2025, dated 01.07.2025, that "the petitioner shall stay at Yanam and report before the Station House Officer, Yanam, Puducherry, everyday at 10.30 a.m., and 5.00 p.m., until further orders".
2.The learned counsel appearing for the petitioner would submit that the petitioner herein is now advance stage of pregnancy and she is likely to deliver child in a short period, i.e, within period of fortnight. He would further submit that there is no other person to take care of her if she deliver the baby, requires continuous support from somebody. Hence, he prayed for modification in the present petition.
3.This petition was listed earlier and the learned Additional Public Prosecutor appeared and strongly objected for relaxing the condition on the ground that the petitioner is involved in the case of triple murder and if she return back it will cause law and order problem and also put in danger. 4.The learned counsel for the petitioner further submits that since the petitioner is a lady and she could not continuously stay at Yanam, and she is staying at Yanam from 05.07.2025.
5.Considering the fact that the petitioner is staying away from her home town and staying at Yanam from 05.07.2025 onwards and now she is also in advance stage of pregnancy.
6.In view of the above, this Court is inclined to modify the condition in para No.7(b) imposed on the petitioner in Crl.O.P.No.15253 of 2025, dated 01.07.2025 to the effect that the petitioner shall stay at Villupuram and appear before the Villupuram Town Police Station on alternative days at 10.30 a.m., till she delivers the baby and after a break of two months she shall appear once in a week before the same station until further orders. 7.Accordingly, this criminal miscellaneous petition is ordered. 26-09-2025 gbi Index:Yes/No Speaking/Non-speaking order Internet:Yes
