ORDER
The petitioners who apprehend arrest for the alleged offences under Sections 194(3) of BNSS @ 108, 49, 85 of BNS (174(3) CrPC @ 306, 109, 498A in Crime No. 148 of 2025 on the file of the respondent police, seek anticipatory bail.
2.The case of the prosecution is that the 3rd daughter of defacto complainant married one Veeramani on 08.12.2024 by love marriage without the knowledge of the defacto complainant and there was a frequent quarrel between the husband and wife. While so on 30.05.2025, about 12.00 hours in the noon, the said Veeramani called the defacto complainant over phone and told that his wife the 3rd daughter of the defacto complainant had quarreled with him and left home and did not return and asked whether she came there. The defacto complainant had made a search and on 30.05.2025 at 06.00 hours in the evening, when she made a search at Pazhayagaram, her third daughter was lying dead in the Thamaraikulam pond nearby the house of Veeramani. 3.The learned counsel for the petitioners submitted that there was a wordy quarrel between Veeramani and the third daughter of the defacto complainant and the daughter committed suicide. The petitioners have been falsely implicated in this case. The petitioners are ready to abide by any condition that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioners.
4.The learned Government Advocate (Crl. Side) appearing for the respondent submitted that the petitioner and the 3rd accused committed dowry harassment and abatement of suicide of the deceased. Hence, he vehemently opposed to grant bail to the petitioners. 5.Considering the fact that the petitioners have committed dowry harassment and abatement of suicide, due to the same, the third daughter of the defacto complainant was lying dead in the Thamaraikulam pond nearby the house of Veeramani, and also considering the gravity of the offences, this Court is not inclined to grant anticipatory bail to the petitioner. 3\5
