(Order of the Court was made by R.SUBRAMANIAN, J.) These petitions have been filed seeking condonation of delay of 26 days in seeking to set aside the abatement caused due to the death of the sole respondent in the Appeal, to set aside the abatement and to bring on record the legal representatives of the deceased sole respondent as respondents 2 to 5 in the Appeal.

2. Though the prayer in all these petitions is erroneous from the facts narrated in the affidavit, we are able to gather that these petitions have been filed as stated supra to bring on record the legal representatives of the deceased sole respondent. Though service of notice in these petitions was effected on the proposed parties on 02.01.2024, they are not appearing either in person or through counsel duly instructed. The vakalat filed by one counsel has also been returned.

3. In view of the fact that service is complete, these petitions are ordered. The Registry is directed to carry out the amendment. The learned counsel appearing for the appellant will take steps for service on the newly added parties in the Appeal through Court as well as privately returnable by 05.06.2024.
