Mr.K.Karthick Jagannath Government Advocate for respondent Nos.1 to 6 Mr.M.Ragul Kousik for respondent Nos.7 to 11
ORDER
(Order of the Court was made by the Hon'ble Chief Justice) Heard.
2. The petitioner has filed this petition, styled as Public Interest Litigation (PIL), seeking to espouse the cause of the plot holders, who have purchased plots in a housing development project developed by respondent Nos.7 to 11, the developers.
3. According to learned counsel for the petitioner, a housing project is being established near a quarry, which is at a distance of 20 - 30 feet on the eastern side of limestone quarry of Arasu Cement Factory, Ariyalur, Ariyalur District. It is further stated that, on the northern side, the distance between limestone quarry and the said land is to an extent of 15 - 20 feet. According to him, as the layout is nearby the limestone quarry, consent from the Pollution Control Board is just and necessary, which has not been obtained.
4. Learned State Counsel, on instructions, would submit that the basis of the petition is factually incorrect and there is no operational quarry.
5. Be that as it may, the issue cannot be allowed to the raised by way of PIL at the instance of the petitioner, who is a busybody. None of the persons, who have purchased plots in the housing project, have come forward. Therefore, we are not inclined to
examine it.
6. Petition is dismissed. There shall be no order as to costs. (MANINDRA MOHAN SHRIVASTAVA, CJ) (SUNDER MOHAN,J) 28.08.2025 Index :
