O R D E R
The petitioner herein who was arrested on 09.07.2025 in connection with Crime No.94 of 2025 for the alleged offence under Sections 409, 467, 1/5
468, 471 and 420 IPC, seeks bail.
2.The allegation against this petitioner is that this petitioner is an account holder in Induslnd Bank at Anna Nagar Branch. The 2nd accused is the Branch Manager of the said branch. This petitioner and other accused who are holding account in the very same branch colluded with A2 and illegally transferred a sum of Rs.4,36,70,000/- from the defacto complainant's account to the other accounts and subsequently, withdrawn the same. Hence the case.
3.The learned Senior Counsel appearing for the petitioner submitted that this petitioner is arrayed as A5. It is true that she is holding an account in the said branch and without her specific knowledge, the 2nd accused / Branch Manager had transferred the funds from the defacto complainant's account to the petitioner's account and the same has also been withdrawn by the 2nd accused. The petitioner was not aware of the above transactions and she did not even receive any alert message sent by the bank through mobile. He further submitted that the petitioner is a lady and she is in custody for a long period. Hence, he prays to grant bail to the petitioner. 2/5
4.The learned Government Advocate (Crl. Side) appearing for the respondent submitted that the defacto complainant as a NRI had invested a sum of Rs.4,36,70,000/- as Fixed Deposit in the Induslnd Bank, Anna Nagar Branch. This petitioner and other accused who are holding account in the very same branch colluded with A2 and illegally transferred a sum of Rs.4,36,70,000/- from the defacto complainant's account to the other accounts and subsequently withdrawn the same. He further submitted that specifically, through this petitioner's account a sum of Rs.76,33,644/- was transferred and subsequently, those amounts were withdrawn by this petitioner by issuing self cheque from July 2022 to March 2023. Hence, he opposed to grant bail to the petitioner.
5.I have considered the submissions made on both sides. On perusal of the record it reveals that the 2nd accused had induced the petitioner to allow her to transfer the amount from the bank, stating that some NRIs money has to be received by her and the same has to be deposited in the petitioner's account and after receiving the amount, she would take back the amount and she will give some benefits to the petitioner. petitioner also agreed for the same and her account was utilized for transfer and withdrawal of funds to the extent of Rs.76,33,644/-. Thereafter, the petitioner was arrested and remanded to judicial custody on 09.07.2025. It is also stated that the other account holders who are arrayed as A3, A4, A6 and A7 were also arrested and still in custody and A2 is still absconding. 6.In view of the fact that the petitioner is a lady and in custody from 09.07.2025 and the entire transactions are covered by the documentary evidence and also considering the fact that A2 induced the petitioner to use her account for transferring and withdrawal of funds, I am inclined to grant bail to the petitioner with certain conditions.

Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Metropolitan Magistrate, Addl. CCB Cases, Egmore, Chennai, and on further conditions that:
[a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal 4/5
Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity;
[b] the petitioner shall report before the respondent police daily at 10.30 a.m., for a period of two weeks and thereafter, as and when required for the interrogation;
[c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];
[d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 24.09.2025 smv Note :
