The petitioner, who was arrested and remanded to judicial custody on 24.10.2021, for the offences punishable under Sections 120(b), 109, 147, 148, 341, 302 of IPC r/w Sections 3 & 4 of Explosive Substances Act, 1908 r/w 149 IPC, in Crime No.185 of 2021 on the file of the respondent police, seeks bail.

2. This is the second bail application before this Court. When the earlier bail application in Crl.O.P.No.14360 of 2022 was listed before the Hon'ble Justice G.K.Ilanthiraiyan on 23.06.2022, the petitioner had sought for permission to withdraw the petition and he had also made an endorsement to that effect. Therefore, this Court had dismissed the petition as withdrawn with a liberty to file a fresh petition after examination of witnesses during trial.

3. The learned Public Prosecutor (Puducherry) would submit that as on date the trial has not yet commenced and there is no change of circumstances and he oppose for grant of bail.
