The petitioner, who is a single accused, was arrested and remanded to judicial custody on 25.03.2016 for the alleged offences punishable under sections 406, 419, 465, 471 IPC, in Crime No. 801 of 2016 on the file of the respondent police and hence, seeks bail.

2. The case of the prosecution is that the accused was working as a Manager in the Life Style International Pvt., Ltd., and he misappropriated a sum of Rs.3,41,415/-.

The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and he has been falsely roped in this case and he has been in judicial custody for more than 11⁄2 years. It is further submitted that the petitioner is ready and willing to deposit a sum of Rs.1,50,000/- to show his bona fides.

4. The learned Government Advocate (Criminal side) appearing for the respondent would submit that the major part of the investigation is over and as per the complaint, the accused has misappropriated a sum of Rs.3,50,000/- from the de-facto complainant.

5. Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner with certain conditions.

6. Accordingly, the petitioner is ordered to be released on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned XVIII Metropolitan Magistrate, Saidapet, Chennai, and on further condition that the petitioner, as per his undertaking, shall deposit a sum of Rs.1,50,000/- to to the credit in Crime No. 801 of 2016 on the file of the learned XVIII Metropolitan Magistrate, Saidapet, Chennai, within a period of four weeks from the date of his release and on such deposit, the learned Magistrate concerned shall disburse the same to the de-facto complainant after giving notice to the petitioner and on further condition that the petitioner shall report before the respondent police daily at 10.00 a.m., until further orders.
