ORDER

This writ petition has been filed challenging the impugned online rejection order passed by the respondent and for a consequential direction to the respondent to issue legal heirship certificate on the demise of her husband Mr.A.Murugan.

2.Heard Mr.C.K.M.Appaji, learned counsel appearing on behalf of the petitioner and Mr.R.Neelakandan, learned Additional Advocate General appearing on behalf of the respondent.

3.The online application submitted by the petitioner has been rejected mainly on the ground that the petitioner was married to the said Murugan for the second time and therefore, there is no scope for issuing legal heirship certificate.

3/6 4.The learned counsel for the petitioner submitted that the petitioner was married to one Mr.Palani Pandidhar and he died on 04.04.2002. There were children out of the first marriage. The petitioner thereafter married the said Murugan in the year 2003. The said Murugan passed away on 14.08.2024. After his demise, the petitioner submitted the application and without conducting any enquiry, the same has been rejected through online mode. 5.In the considered view of this Court, if the report of the Village Administrative Officer has stated that the petitioner has married the said Murugan for the second time, the petitioner should have been called for an enquiry to ascertain as to whether this marriage had taken place after the demise of the first husband. The specific case of the petitioner is that this marriage had taken place after the demise of her first husband. 6.In view of the above, the petitioner is directed to submit a fresh application to the respondent seeking for legal heirship certificate by adding the

4/6 names of all the legal heirs. The respondent shall call the petitioner for an enquiry and ascertain as to whether the petitioner married Late Murugan after the demise of her first husband. In any case, final decision shall be taken, within a period of four weeks from the date of receipt of the fresh online application from the petitioner.
